General Conditions
The following Terms and Conditions apply to the Affiliate Program of the website erapetfood.com and regulate the collaboration relationship between PETS AWAY STORE S.L., hereinafter referred to as ERAPETFOOD, and the affiliates participating in this program. The Affiliate Program allows you to promote Erapetfood products and receive commissions in accordance with the provisions of these Terms and Conditions. These Terms include, by reference, the Terms of Use and Privacy Policy of this website.
These conditions will apply between affiliates and PETS AWAY STORE S.L.
The privacy policy and legal notice of this website are also applicable to affiliates and these conditions.
Participation in the Affiliate Program
To enroll in the Program, the candidate must register using the form available on the affiliate registration page. Your application may be denied or canceled at any time if, for any reason, you are not considered eligible by the Program.
Your Responsibilities as an Affiliate
As an Affiliate of Erapetfood, you agree that:
- You are responsible for providing complete and accurate account information and keeping that information up to date. This information may include, among other things: contact information, all URLs of websites where Erapetfood and online store products are promoted, advertising practices and media, payment information, etc. Failure to provide accurate information may result in your expulsion from the Program or the suspension or termination of your affiliate account and the loss of potential commissions.
- You will act in good faith when recommending and referring customers.
- You will not take any actions or make recommendations to your referrals that could potentially lead to a loss of revenue for Erapetfood.
- You do not have to participate in incentivized programs or business opportunity sites that use marketing practices that may be unethical or likely to attract customers of bad reputation.
If a pattern in your Affiliate practices is detected that, in our opinion, violates any aspect of these Terms and Conditions, your Affiliate account may be suspended or terminated, and all pending commission payments may be canceled.
Affiliate Advertising
When promoting Erapetfood, you may create your own promotional materials using the content available on the erapetfood.com website. Materials may include trade names, service marks, or logos of Erapetfood that you may display on your affiliate website or blog. The use of these materials should be understood as limited solely to promote the Erapetfood online store, without ever impersonating the original site. Modification of the contents related to the promoted products is not allowed, nor affecting copyrights or any type of ownership rights belonging to third parties.
Erapetfood will have the right to decide if a promotion method you use is appropriate. The use of any promotion method deemed inappropriate could result in a warning, suspension, and subsequent termination of your account, along with the cancellation of all pending commission payments.
Affiliate Tracking Cookies
We automatically track Affiliate sales using cookies. Cookies are placed in the user’s browser who clicks on the affiliate link to access our website. All cookies are stored for 3 days. If there is any previous affiliate cookie in the same user’s browser, it will be overwritten with the new cookie.
Therefore, the commission is received by the last affiliate who referred the customer to Erapetfood’s website and completed their first purchase.
Erapetfood will not assume any responsibility for cookies intentionally deleted by users.
Lifetime Commissions
When a customer makes their first purchase at Erapetfood and is assigned to an affiliate, they are permanently assigned to that affiliate’s account. All subsequent purchases, including subscriptions, made by the customer will generate a commission only for that affiliate.
In case of termination of the collaboration relationship between the affiliate and Erapetfood, the customers they had assigned will be released and may be referred by other affiliates.
Affiliate Commissions
Erapetfood will pay the affiliate a commission for any valid sale derived from 10% of the purchase price.
Your Affiliate account must be active at the time of the sale. No commissions will be paid for sales made before registering in the Affiliate Program.
The commission will be assigned to the Affiliate once the withdrawal or return period of the product purchased by the referred Customer has elapsed. We reserve the right to extend the retention period without prior notice for the time we reasonably consider necessary to determine the validity of the sale.
Commission payments are processed on the 25th of each month upon the affiliate’s request. A minimum of €50 must have been generated for commission payment. If the minimum is not reached, the generated commissions will accumulate for the following month.
The Affiliate is solely responsible for keeping all their information up to date, including postal address, email address, name, payment information, tax information, and any other personal information that may impact commission payment processing.
Erapetfood may suspend commission payments to the Affiliate at any time and for any period if there is evidence that the Affiliate or any of their referred customers have engaged in fraudulent or illegal activity or a potential breach of these Terms.
We reserve the right to deduct from the Affiliate’s current and future commissions any commission paid for fraudulent, questionable, or canceled sales.
Relationship between the Parties
Both Erapetfood and the Affiliate agree that they enter into this Agreement as independent contractors, and none of the provisions of this Agreement shall give rise to a partnership, joint venture, agency, franchise, or commercial or employment relationship between them.
The Affiliate is not authorized to make or accept offers or representations on behalf of Erapetfood. The Affiliate shall not make statements, whether on the Affiliate’s website or elsewhere, that may contradict any of the provisions of this clause.
Limitation of Liability
The Affiliate agrees that, to the maximum extent permitted by applicable law, under no circumstances, including, among others, negligence, shall Erapetfood or third-party providers be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including, among others, damages for lost profits, cost savings, revenue, business, usage data, as well as any other pecuniary loss suffered by the affiliate or any third party.
The affiliate agrees that the above limitations shall apply, whether based on contract, tort, or any other legal basis, and shall apply even if we have been advised of the possibility of such damages.
In no event shall we be liable to the Affiliate for any breach, defect, or liability claim under these Terms and Conditions or any other document for an amount exceeding any amount paid by the Affiliate during the one-month period prior to the claim giving rise to such liability.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. The Affiliate agrees that, in such jurisdictions, our liability shall be limited to the extent permitted by law.
Termination of Affiliate Account
The Affiliate may cancel and terminate their Affiliate account at any time by notifying Erapetfood of their withdrawal.
- Erapetfood may terminate an Affiliate account: Immediately and without prior notice if the Affiliate or their account has violated these Terms and Conditions.
- With a seven-day notice period without the need to provide reasons.
Modification of Terms
Erapetfood may modify these Terms and Conditions of the Affiliate Program at any time without prior notice to the Affiliate. The updated Terms and Conditions are always available on the erapetfood.com website. If you do not agree with any modification, you should cancel your Affiliate account.
